인권에 대한 무지와 소홀함과 경멸이 공공 재난과 정부 부패의 유일한 원인이라고 믿는, 국민의회로 조직된, 프랑스 민중의 대표자들은, 사회의 모든 구성원들이 언제나 그들의 권리와 의무를 상기하고, 입법권과 행정권 행사가 언제라도 모든 정치적 제도의 목적과 대상에 부합되는지를 비교하여 좀 더 신중하게 행사되도록 하고, 앞으로는 단순하면서도 의심할 바 없는 원칙에 기초하여 시민들의 불편과 고충을 해결하기 위해 헌법이 유지되고 만인의 행복이 증진되도록 하기 위해, 인간이 갖는 빼앗길 수 없는 신성한 자연권을 선언하기로 결정했다. 그러므로 국민의회는 절대적 존재의 후원아래 인간과 시민의 다음과 같은 권리를 인식하고 선언한다.

제1조. 인간은 권리에 있어 자유로우며 평등하게 태어나고 생존한다. 사회적 차별은 오직 일반적인 선에 기초하여 마련된다.

제2조. 모든 정치적 단결의 목적은 소멸될 수 없는 인간의 자연권을 보존하기 위한 것이다. 이들 권리란 자유 재산권, 안전 및 억압에 대한 저항을 뜻한다.

제 3 조. 모든 주권의 원리는 본질적으로 국민에게 있다. 어떤 단체나 개인을 막론하고 국민으로부터 직접 유래하지 않는 어떠한 권한도 행사할 수 없다.


제4조. 자유란 다른 사람을 해치지 않는 한 뭐든지 할 수 있다는 것을 의미한다. 그러므로 각 개인의 자연권 행사는 사회의 다른 구성원도 동등한 권리를 누릴 수 있다는 점을 제외하고는 어떤 제한도 받지 않는다. 이러한 제한은 오직 법에 의해서만 정해진다.


제5조. 법은 오직 사회에 해로운 행위만을 금지한다. 법에 의해 금지되지 않는 한 아무 것도 방해받지 않으며, 누구도 법에 의해 규정되지 않은 일을 하도록 강요받지 않는다.

제6조. 법은 일반 의지의 표현이다. 모든 시민은 직접 또는 대표자를 통하여 법의 제정에 참여할 권리를 가진다. 법이 보호하는 것이든 금지하는 것이든, 모든 경우에 똑 같다. 모든 시민은 법 앞에 평등하며, 그들의 품성이나 능력을 제외하고는 아무런 차별 없이 능력에 따라 직업을 택하고, 공직을 맡고, 모든 지위를 얻을 수 있는 동등한 자격이 있다.

제7조. 법에 의해 규정된 경우를 제외하고는 아무도 고발되거나 체포되거나 투옥 당하지 아니한다. 뇌물을 요구하거나, 피의자를 이송하거나, 집행을 함에 있어 독단적인 명령은 처벌되어야 한다. 법에 의하여 소환되거나 체포된 모든 시민은 혐의 사실에 대한 항변을 위해 지체없이 재판에 회부되어야 한다.


제8조. 법은 처벌을 위해 엄격하고 명확해야만 한다. 누구도 의회에서 통과된 법이나 사법 당국에 의해 유죄라고 선언되지 않는 한 어떠한 처벌이나 고통을 받아서도 안 된다.

제9조. 모든 사람들은 유죄 선고를 받기 전에는 무죄로 추정되어야 하며, 체포는 불가피한 경우에만 이루어져야 하며, 피의자의 신병 확보에 필수적이 아닌 한 모든 가혹한 대우는 법에 의해 엄격히 제한되어야 한다.

제10조. 누구도 법의 의해 확립된 질서를 교란하지 않는 한, 종교적 견해를 포함한 자신의 의견이나 발표로 인해 신변에 불안을 느끼게 해서는 안된다.

제11조. 사상 및 의견의 자유로운 전달은 인간의 가장 소중한 권리의 하나이다. 따라서 모든 시민은 자유롭게 말하고, 쓰고, 인쇄할 수 있다. 그러나 법에 규정된 경우처럼 이러한 자유의 남용에 관해서는 책임을 져야만 한다.


제12장. 인권과 시민권의 보장을 위해 공권력은 필요하다. 그러나 공권력은 권력을 위임받은 사람들의 이익이 아니라, 모든 사람의 이익을 위해 확립되어야 한다.

제13조. 공권력의 유지와 행정상의 비용을 위해 조세는 필연적이다. 조세는 모든 시민들에게 각자의 재산 규모에 맞춰 공정하게 부과되어야 한다.

제14조. 모든 시민은 스스로 또는 대표자를 통해 공공 지출이 필요한 가를 결정할 권리, 그것을 승인할 것인지를 결정할 권리, 그것을 어떻게 사용될 것인지 알 권리, 그 비용 즉 조세를 어떠한 방식으로 어떤 비율로 거둘 것인지를 결정할 권리가 있다.


제15조. 사회는 모든 공무원에게 회계 자료를 요구할 권리가 있다.


제16조. 법의 준수가 보장되지 않거나 권력 분립이 이루어지지 않는 사회는 결코 헌법을 가지고 있다고 말할 수 없다.

제17조. 재산권은 신성 불가침한 것이므로, 누구도 공익을 위해 필요하고, 법에 의해 규정된 경우, 또한 소유자가 사전에 정당한 보상을 받는다는 조건이 아니고는 빼앗기지 않는다.

The representatives of the French people, organized as a National Assembly, believing that the ignorance, neglect, or contempt of the rights of man are the sole cause of public calamities and of the corruption of governments, have determined to set forth in a solemn declaration the natural, unalienable, and sacred rights of man, in order that this declaration, being constantly before all the members of the Social body, shall remind them continually of their rights and duties; in order that the acts of the legislative power, as well as those of the executive power, may be compared at any moment with the objects and purposes of all political institutions and may thus be more respected, and, lastly, in order that the grievances of the citizens, based hereafter upon simple and incontestable principles, shall tend to the maintenance of the constitution and redound to the happiness of all. Therefore the National Assembly recognizes and proclaims, in the presence and under the auspices of the Supreme Being, the following rights of man and of the citizen:

1. Men are born and remain free and equal in rights. Social distinctions may be founded only upon the general good.

2. The aim of all political association is the preservation of the natural and imprescriptible rights of man. These rights are liberty, property, security, and resistance to oppression.

3. The principle of all sovereignty resides essentially in the nation. No body nor individual may exercise any authority which does not proceed directly from the nation.

4. Liberty consists in the freedom to do everything which injures no one else; hence the exercise of the natural rights of each man has no limits except those which assure to the other members of the society the enjoyment of the same rights. These limits can only be determined by law.

5. Law can only prohibit such actions as are hurtful to society. Nothing may be prevented which is not forbidden by law, and no one may be forced to do anything not provided for by law.

6. Law is the expression of the general will. Every citizen has a right to participate personally, or through his representative, in its foundation. It must be the same for all, whether it protects or punishes. All citizens, being equal in the eyes of the law, are equally eligible to all dignities and to all public positions and occupations, according to their abilities, and without distinction except that of their virtues and talents.

7. No person shall be accused, arrested, or imprisoned except in the cases and according to the forms prescribed by law. Any one soliciting, transmitting, executing, or causing to be executed, any arbitrary order, shall be punished. But any citizen summoned or arrested in virtue of the law shall submit without delay, as resistance constitutes an offense.

8. The law shall provide for such punishments only as are strictly and obviously necessary, and no one shall suffer punishment except it be legally inflicted in virtue of a law passed and promulgated before the commission of the offense.

9. As all persons are held innocent until they shall have been declared guilty, if arrest shall be deemed indispensable, all harshness not essential to the securing of the prisoner's person shall be severely repressed by law.

10. No one shall be disquieted on account of his opinions, including his religious views, provided their
manifestation does not disturb the public order established by law.

11. The free communication of ideas and opinions is one of the most precious of the rights of man. Every citizen may, accordingly, speak, write, and print with freedom, but shall be responsible for such abuses of this freedom as shall be defined by law.

12. The security of the rights of man and of the citizen requires public military forces. These forces are, therefore, established for the good of all and not for the personal advantage of those to whom they shall be intrusted.

13. A common contribution is essential for the maintenance of the public forces and for the cost of administration. This should be equitably distributed among all the citizens in proportion to their means.

14. All the citizens have a right to decide, either personally or by their representatives, as to the necessity of the public contribution; to grant this freely; to know to what uses it is put; and to fix the proportion, the mode of assessment and of collection and the duration of the taxes.

15. Society has the right to require of every public agent an account of his administration.

16. A society in which the observance of the law is not assured, nor the separation of powers defined, has no constitution at all.


17. Since property is an inviolable and sacred right, no one shall be deprived thereof except where public necessity, legally determined, shall clearly demand it, and then only on condition that the owner shall have been previously and equitably indemnified.
